- In consideration of the Journal of Histochemistry & Cytochemistry agreeing to publish the Contribution, the Authors (or author in the case of a sole author) grant to JHC the sole and exclusive, irrevocable royalty-free, right to publish, reproduce, distribute, transmit, display, store, translate, perform, create derivative works from and otherwise use the Contribution in any form, manner, format, platform, or medium, whether now known or hereafter developed, throughout the world and in any language, for the entire term of any such right and any renewal or extension thereof and to permit/sublicense to others to any or all of the foregoing as well. Notwithstanding anything to the contrary herein, JHC has no obligation to use the Contribution. In the event that JHC uses the Contribution, JHC shall provide appropriate attribution to The Authors. In conjunction with that attribution and any promotion or advertising of the Journal, the Authors grants JHC the worldwide, perpetual, irrevocable right to use and permit others to use the Authors' name, voice, approved photograph, likeness and biographical materials concerning the Authors.
- Ownership of the copyright remains with the Authors, provided that, when re-producing the Contribution or extracts from it, the Authors acknowledge first and reference publication in the Journal. The Authors retain the following non-exclusive rights:
- To reproduce the Contribution in whole or in part in any printed collection or thesis of which they are the authors.
- Present the Contribution or any part thereof orally.
- To reproduce the Contribution in whole or in part for the purpose of course teachings as part of their work or for the institution where they work.
- To post the accepted for publication, peer-reviewed version of the Contribution on the authors own website or in their employer's repository six months after publication of the print edition of the Journal and provide a hyperlink to the published work on the Journal of Histochemistry & Cytochemistry website.
- Reuse figures, graphs and images created by the Authors, which are part of the Contribution, in future works of the Authors.
- The Authors warrant and represent that:
- The Contribution is original and not been previously published in whole or in substantive part without citing the source of previous publication.
- The findings, images and data reported and facts represented in the Contribution are true and accurate to the best of the Authors' knowledge.
- None of the data, observations or images have been fabricated, manipulated, falsified, or altered in any way that would misrepresent the actual findings.
- All of the authors contributed substantially to the conduct of the research and writing of the article, and that all authors take responsibility for the accuracy and interpretations of the findings.
- Nothing in the Contribution conflicts with the Policy on Plagarism as established by the Office of Scientific Integrity of the U.S. Department of Health and Human Services <http://ori.dhhs.gov/policies/plagiarism.shtml>.
- The Authors are sole authors and sole owners of the copyright in the Contribution. If the Contribution includes any materials owned by or regulated by a third party, the Authors have gained permission of the owners of the copyright in all such materials to enable them to grant the rights contained herein. Copies of all such permissions are attached to this license.
- The Author who has signed this agreement warrants that she/he has full right, power and authority to enter into this Agreement on behalf of the Authors.
- The Authors authorize the Journal of Histochemistry and Cytochemistry to take steps when it considers necessary, at its own expense, in the Authors name and on their behalf if it believes that copyright infringement of the Contribution by a third party has occurred.
- The Authors hereby consent to the inclusion of a hyperlink from the Contribution to third party material wherever that material may be located.
- This Agreement shall remain in effect for the duration of the copyright and may not be revoked without the express written agreement of both parties.
- This Agreement shall be governed and construed, in accordance with the laws of the state of Washington, United States of America, without resort to the conflicts of laws principles thereof.
- The Authors shall for all purposes be considered an independent contractor and nothing in this Agreement shall be deemed to place the parties in the relationship of employer-employee, principal-agent, partners or joint ventures.
- There shall be no payment or royalties due from one party to the other in exchange for the rights granted herein. Each party shall bear its own costs and fees associated with this Agreement.
- The Authors' rights and remedies in the event of a breach of this Agreement will be limited to the Authors' right, if any, to recover damages in an action of law. In no event will the Authors be entitled by reason of any breach or alleged breach, to enjoin, restrain or seek to enjoin or restrain the publication or distribution of the Journal.
- JHC will have the right to assign this Agreement, or any of its rights hereunder and this Agreement is binding upon and will inure to the benefit of any such assignee.
A signed license agreement must be submitted to the Journal of Histochemistry & Cytochemistry before the Journal can accept a manuscript for publication. The terms of the license will not apply if the manuscript is not published. The Journal will not accept substitute licenses, addenda, or any changes to this form. Alterations of this form will result in delayed processing of your manuscript for publication.
The purpose of this document is to transfer the copyright in the above-mentioned manuscript and all portions thereof (whether in printed, electronic or any other form now known or hereinafter invented from the author(s) to The Histochemical Society, publisher of The Journal of Histochemistry and Cytochemistry.
